Abstract

The author notes in the article that the consideration of the administrative offense case by the National Police of Ukraine is an important procedural moment in the proceedings in administrative offense cases. The determination of the moment of initiation of consideration of the administrative offense case is an important issue carrying out by the National Police of Ukraine. Bringing to administrative responsibility begins from the moment of drawing up the protocol and presenting it to the person who has to be bringing to administrative responsibility. The author also notes in the article the everyday problems faced by employees of the National Police of Ukraine when drawing up protocols on administrative offenses. Drawing up a protocol on administrative offense must necessarily be preceded by a qualitative legal analysis of the detected offense and establishing whether the actions (inaction) of the offender are subject to documentation. This is necessary for the correct qualification of an administrative offense and for choosing the type and measure of administrative penalty during the case review. The established fact of committing an illegal act, for which the current Code of Ukraine on administrative offenses provides for administrative liability, is a subject to official documentation. Officials of the National Police are obliged to draw up a report on an administrative offense. Also, drawing up a report on administrative offense must be preceded by work on identifying and properly processing evidence of an administrative offense. Based on the results of the study, it has been proposed to implement the institute of administrative investigation by the employees of the National Police of Ukraine by making appropriate changes to the Code of Ukraine on Administrative Offenses. The decision to conduct an administrative investigation must be made by an official of the National Police of Ukraine, authorized to draw up, according to the rules of the Code of Ukraine on Administrative Offenses, a protocol on administrative offense in the form of a resolution under clear circumstances, which must also be defined in the Code of Ukraine on Administrative Offenses.
