USING DIGITAL TECHNOLOGY TO IMPROVE CIVIL JUSTICE OUTCOMES: INTERNATIONAL EXPERIENCE

Abstract

This article is devoted to the study of the positive experience of foreign countries in the field of improving the efficiency of civil justice through the use of modern information technologies. In particular, the use of modern technologies to resolve minor disputes in civil proceedings is of particular interest. Today, many of these disputes are resolved through the traditional civil justice system, however, sometimes the costs of resolving such disputes are disproportionate to the amount of the dispute. This state of affairs not only does not contribute to the protection of violated rights, but also raises concerns about the proper implementation of access to justice. Therefore, facilitating access to justice with the help of information technologies has a special potential to resolve minor civil disputes quickly, economically and procedurally fairly. In particular, the article examines online dispute resolution platforms (ODR), which are developed in the commercial sphere and are actively used to resolve disputes between sellers and consumers of goods and services. The article focuses special attention on the significant potential of these technologies, which are able to resolve a large number of small civil disputes more quickly, with lower material costs for the parties and with a greater number of satisfied users compared to traditional processes and procedures of civil litigation. It is emphasized the need to carefully observe the goals of civil justice and its basic principles when developing and implementing such platforms in justice. The technologies used in justice must be safe and reliable, ensure the preservation of confidential information of the considered disputes and technically guarantee information security for users of these technologies. That is why online dispute resolution platforms must constantly improve technically by involving innovations, including artificial intelligence technologies.
