Abstract

The article analyzes the legal system of Ukraine and the influence of Roman law on it. The theoretical and legal aspect of the essence and content of the reception of law, the reception of Roman law in the legal system of Ukraine and its harmonization according to the peculiarities of the legal system is revealed. The role and significance of Roman law in the legal system of Ukraine were clarified. The characteristic features of the process of reception of Roman law in the legal system of Ukraine in different historical epochs are analyzed. The degree of influence of Roman law on modern law was determined, and this allowed to adequately assess the general patterns, the most significant achievements and problems in the formation of the modern legal system. The historical development of the genesis of the legal system, institutions and branches of law of Ukraine is considered. The role and significance of the influence of Roman private law on the development of legal regulation of civil relations are determined. The process of transformation of Ukrainian law, which is caused by the reproduction of the traditions of the Romano- Germanic legal family, is described. It was found that in the process of historical development the legal system of Ukraine was favorably influenced by Roman private law, although its national features were preserved. It is proved that the historical origin and development of domestic law is traditionally connected with the Roman legal doctrine, which, first of all, manifested itself in Russian Truth, Lithuanian statutes, “Rights of the Little Russian People” and other monuments of Ukrainian law. The historical and legal conditions of the influence of Roman law on the process of regulation of relations in the Ukrainian lands (IX–XX centuries) are analyzed. Much attention is paid to the analysis of the reception of Roman law in the sources of law in the then Ukrainian lands, primarily in n truth, Lithuanian statutes, the rights of the Little Russian people in 1743, the Collection of Little Russian rights in 1807. The influence of some provisions and ideas of Roman law in the process of codification of Ukrainian Soviet civil law. The modern period of formation of modern legal systems under the influence of Roman law is determined.
