FEATURES OF THE CONSTITUTIONAL DEFINITION AND LEGAL REGULATIONS RIGHTS TO JUDICIAL PROTECTION IN UKRAINE

Despite the undisputed recognition of the social value enshrined in Article 6 of the Convention on the Protection of Human Rights and Fundamental Freedoms “right to a fair trial”, the analysis of Ukrainian legislation shows that its legal regulation needs improvement. It is not by chance that certain aspects of it became the subject of consideration by the Constitutional Court of Ukraine.And since it is obvious that other aspects of this problem need scientific attention, this study was conducted in order to help solve these problems and develop proposals aimed at bringing them into compliance with European standards.In the course of the study, the author used a number of general scientific and special methods of cognition, comparative and legal method, system analysis and synthesis method, systematization and classification, formal and dialectical logical.
