INCORPORATION AS A FORM OF ORGANIZING CURRENT LEGISLATION IN UKRAINE

Abstract

The article examines general theoretical issues of legislation incorporation. Based on the analysis of scientific approaches, it can be concluded that legislative incorporation is one of the forms of systematization characterized by external organization of normative legal acts through their consolidation into collections according to specific criteria and rules, with corresponding official amendments and additions. The article notes that incorporation is the least complex form of systematization, yet it is important as its fundamental, initial element, closely related to other forms of systematization. In particular, incorporation by subject matter forms the basis of consolidated legal acts. Thanks to scientific-theoretical activity and its results, the process of codification begins. Thus, incorporation serves as an incentive for initiating active efforts to change and improve legislation. Incorporation itself allows understanding the current state of legislation. Based on the results of incorporation, it is possible to draw conclusions about the shortcomings and positive aspects of such legislation and further improve it. It is concluded that legislation incorporation should be carried out in accordance with certain criteria and rules. In turn, this allows distinguishing incorporation from other forms of systematization, working on the formation of an incorporative collection without resorting to elements of consolidation or codification.
