STAGES OF DEVELOPMENT OF THE DRAFT REGULATORY- LEGAL ACT

Abstract

In the article the main stages of development of the draft normative-legal act as an important stage of the law-making process are defined and their characterization was carried out. It has been established that regulations are a significant means for regulating public relations, solving problems and implementing the functions of the country. Therefore, it is important that their content complies with the principle of legal certainty, which is the basis for their equal application, which makes social relations stable. The level of legal security in the state also depends on the level of legal certainty, because vagueness, ambiguity, and inconsistency of legal norms lead to a decrease in the effectiveness of legal regulation. It is substantiated that one of the important issues that require further scientific study in order to streamline law-making activities and improve the legal regulation of public relations in the context of European integration processes in Ukraine is the issue of effective, high-quality and consistent development of draft regulatory-legal acts, compliance with the requirements of standard design technology. It has been established that the development of the draft regulatory-legal act should include the following stages: 1) preparation of the text of the draft regulatory-legal act, an explanatory note and other accompanying documents to it; 2) carrying out an assessment of the impact of the draft normative-legal act on public relations, presenting its results in an explanatory note; 3) assessing the compliance of the draft regulatory-legal act with Ukraine’s obligations in the field of European integration and the law of the European Union (EU acquis); 4) organizational and technical support for the preparation of the draft regulatory-legal act; 5) conducting public consultations (except for cases provided for by law); 6) coordination of the draft regulatory-legal act with the relevant government bodies, local government bodies in cases established by law. At the same time, attention is focused on the fact that during martial law in Ukraine, subjects of law-making activity can adopt (issue) normative-legal acts without following such stages of development of the draft normative-legal act as: assessing the impact of the draft normativelegal act on public relations, outlining its results in an explanatory note; organizational and technical support for the preparation of the draft regulatory-legal act; holding public consultations. It is concluded that a well-established rule-making technology can ensure not only the proper quality and effectiveness of regulatory-legal acts, but also ensure their positive impact on the political, economic and social processes taking place in the state.
