THE LEADING ROLE OF THE REPRESENTATIVE BODY IN THE PROCEDURE FOR THE EXECUTION OF ECTHR DECISIONS AGAINST UKRAINE AND ITS INFLUENCE ON THE EXECUTIVE PROCESS

The article outlines the leading role of the representative body in the procedure for the execution of ECtHR decisions against Ukraine and its influence on the executive process. Determined that according to the current legislation, the representative body is the body responsible for ensuring the representation of Ukraine at the European Court of Human Rights and coordinating the implementation of its decisions. Attention is focused on the role of the representative body in the enforcement process, which consists in sending the debt collector a message explaining his right to submit an application to the state executive service for the payment of compensation (just satisfaction), applying for the execution of the decision regarding the payment of compensation in an undisputed manner by the central body of the executive authorities implementing state policy in the field of treasury service of budget funds and control over their actual payment. A comparative analysis of the powers of the representative body and the state executive service in the procedure for the execution of the decisions of the European Court was made and it was concluded that they are limited in nature due to the presence of procedural features peculiar to it, which consist only in the issuance of procedural documents – the decrees of the state executive on the opening of executive proceedings and its termination. The coordination function of the representative body with other bodies (institutions) involved in the implementation of the Court's decision is revealed, especially when taking additional measures of an individual nature (restoration of the previous legal status of the debt collector by re-examining the case) and measures of a general nature. The control function of the representative body over the implementation of the ECtHR decision is outlined. The authority of the representative body is distinguished according to the principle of organizational, legal and procedural criteria, which are structured on the main components of the procedure for the implementation of ECtHR decisions – the executive process, the adoption of additional measures of an individual nature and measures of a general nature.
