Abstract

The article examines the problems of the legal status of human rights during martial law and the process of harmonization of Ukrainian legislation with the legislation of the European Union. The article points out the need to respect human rights during martial law, the introduction of legal mechanisms that would create real guarantees for the realization of the rights and freedoms of a person and a citizen, and points out the need to legislate the limitation of human and citizen rights during the introduction of martial law. A parallel was drawn on the conformity of the norms of the Constitution of Ukraine with the European Convention on Human Rights, which provides for the possibility of withdrawal of the High Contracting Parties from the obligations of the Convention during war or other public danger, if this threatens the life of the nation, provided that the measures to be applied by the state are not will contradict the state's obligations under international law. The steps taken by Ukraine to join the European Union are studied, attention is focused on the fact that European integration is a priority of the Ukrainian authorities, the process of rapprochement of the Ukrainian state with the European Union, both at the level of laws and at the level of rules and customs existing in society , aims, first of all, to improve the standard of living of ordinary Ukrainians. The process of Ukraine signing the association agreement between Ukraine and the European Union is analyzed. It is proven that the introduction of martial law created a threat to stop the process of European integration, as well as a real danger of violation of human and citizen rights, especially in the temporarily occupied territories. Using the example of individual laws, it is shown how modern Ukrainian legislation is adapted in the conditions of martial law. It is indicated that the interaction of Ukraine and the EU in the field of protection of human and citizen rights is undeniable, not only in view of the prospects of integration, but also, first of all, in view of the need to maintain security in Europe, because the security of Europe today directly depends on Ukraine.
