THE CONTENT OF THE RIGHT OF JUDGES TO RESPECT FOR DIGNITY AND HONOR, THE RIGHT TO INVIOLABILITY OF BUSINESS REPUTATION

The article is devoted to the content of the right of judges to respect for dignity and honor, the right to inviolability of business reputation. The article examines the essence of honor, dignity and business reputation as personal nonproperty goods of judges. It is determined that the characteristic features of honor, dignity and business reputation as personal non-property goods are: personal character and non-property, peculiarity of the grounds for their occurrence and termination, variability and uncertainty of the volume, perpetuity. Based on the analysis of the preconditions for characterizing the moral qualities of judges through the category of honor and dignity of a judge and taking into account certain constitutional provisions and the provisions of the Civil Code of Ukraine, it is concluded that in the legal field to talk about the existence of special types of honor and dignity is not necessary. Based on the analysis of the provisions of Articles 271, 297, 299 of the Civil Code of Ukraine, it is concluded that the legislator specifying the content of the right to respect for dignity and honor, the right to inviolability of business reputation actually departed from the traditional doctrinal view on the content of subjective right. On the basis of the generalized analysis of the provisions of the Civil Code of Ukraine, proposals were made to improve certain provisions of the Code, in terms of consolidating the right to honor and dignity, the right to business reputation. According to the results of the study, it was concluded that the content of the right of judges to respect for dignity and honor, the right to inviolability of business reputation, as a subjective rights consists of competencies of the actions of others and competence to protect their rights.
