PROTECTION OF INTELLECTUAL RIGHTS ON TECHNOLOGIES CREATED BY MILITARY SERVANTS

The article provides a comprehensive legal and scientific analysis of the specifics of protecting intellectual property (IP) rights to technologies created by military personnel. It is substantiated that in the context of wartime and post-war development, this issue gains systemic importance, as defense technologies and innovative developments serve as key factors in ensuring national security, defense capability, and the technological capacity of the state.
It is established that the results of intellectual activity of military personnel are characterized by a complex (dual) legal nature, combining the features of IP objects with work products created within public-law relations. This legal construct necessitates a combined regulatory mechanism that integrates private and public law instruments and provides for a special legal regime for objects that may contain information classified as state secrets.
The author analyzes Ukraine's national legislation and identifies key gaps and conflicts in legal regulation, particularly regarding the determination of ownership of economic rights, mechanisms for the commercialization of intellectual results, procedures for determining and paying remuneration to authors, and the lack of unified procedures for the classification and patenting of objects constituting state secrets. It is proved that such deficiencies reduce the effectiveness of law enforcement, create preconditions for legal disputes, and negatively impact the innovative activity of military personnel.
Particular attention is paid to the analysis of international legal standards in the field of intellectual property and their significance for the harmonization of national legislation. Based on the study, proposals for improving legal regulation are formulated. These include ensuring a balance between the state's public interests and authors' private interests, introducing transparent mechanisms for the allocation of rights and remuneration, developing public-private partnerships in defense innovations, and forming an effective institutional model for managing intellectual property in the military sphere.
