CONCEPT AND CHARACTERISTICS OF DEPARTMENTAL REGULATORY LEGAL ACTS OF THE MINISTRY OF INTERNAL AFFAIRS OF UKRAINE

Abstract

The article examines the concepts and features of departmental regulatory legal acts of the Ministry of Internal Affairs of Ukraine, which play an important role in the departmental rule-making activities of law enforcement agencies. The relevance of the topic lies in the need to study scientific views and legislation on the definition of the concept and features of departmental regulatory legal acts of the Ministry of Internal Affairs of Ukraine, which will further determine their place in the system of regulatory legal acts. It was found that at the legislative level there is no separate definition of a departmental regulatory legal act, while the Law of Ukraine «On Law-Making Activities» contains a definition of the concept of a subordinate regulatory legal act. The scientific definitions of the concept of a departmental regulatory legal act in the works of domestic scientists are analyzed. All scientists attribute departmental regulatory legal acts to subordinate regulatory legal acts issued by departments within their competence in order to specify and implement legislative regulatory legal acts. Their sectoral nature, limited scope of action only to a certain department and focus on regulating public relations in the relevant department, in particular in the field of the relevant department of the Ministry of Internal Affairs of Ukraine, are emphasized. The study pays special attention to the features of departmental regulatory legal acts. The following features are distinguished, namely: subordinate nature, officiality, mandatory for execution, written form, multiple application, publication by an authorized entity in accordance with the established procedure, as well as a limited scope of action within the relevant department. Thus, departmental regulatory legal acts of the Ministry of Internal Affairs of Ukraine are necessary for regulating public relations within a certain department of the system of bodies of the Ministry of Internal Affairs of Ukraine. The definition of the concept and features makes it possible to distinguish them among other subordinate regulatory legal acts and effectively implement them in practice.
