Abstract

The article is devoted to the study of the evolution of the legal system of Scotland in the context of preserving institutional independence in the context of integration into the legal space of Great Britain. It is substantiated that the institutional autonomy of the Scottish justice system is ensured through the functioning of its own judicial bodies, as well as through the separation of powers between the Parliament of Scotland and the Parliament of Great Britain. Particular attention is paid to the analysis of the processes of devolution enshrined in the Scotland Act of 1998 and the possibility of adapting individual elements of the Scottish experience to the modern conditions of reforming the justice system in Ukraine.
The historic phases of the development of Scotland's legal framework are examined. The effect of the 1707 Act of Union on maintaining the independence of Scottish jurisprudence is investigated. The present-day structure of power distribution between the Scottish Parliament and the Parliament of Great Britain regarding justice is outlined. The procedures of devolution and their legislative firming are explored, specifically the importance of the Scotland Act of 1998 for broadening the system's self-governance. The relationship between the development of legal institutions and political processes is identified, including the impact of the 2014 Scottish Independence Referendum. A comparative analysis of the legal systems of Scotland and Ukraine is conducted in order to identify common problems and differences in the development of justice institutions. Effective elements of the Scottish experience (institutional, procedural, organizational) that can be adapted to the Ukrainian legal system are identified. Possible risks and limitations of the implementation of Scottish approaches in Ukrainian realities are assessed. Scientifically based recommendations have been formulated on using Scottish experience to improve the justice system in Ukraine.
