FROM “WASTE OWNER” TO “WASTE HOLDER”: CRITICISM OF THE TERMINOLOGY OF THE LAW OF UKRAINE “ON WASTE MANAGEMENT”

The article examines the problem of using the term "waste owner" in the Law of Ukraine "On Waste Management" [1] through the prism of civil legislation of Ukraine, the provisions of Directive 2008/98/EC of the European Parliament and of the Council of November 19, 2008 on waste and repealing certain directives (Waste Framework Directive), (hereinafter – WFD) [2], the practice of the Court of Justice of the European Union, and subordinate regulatory acts of Ukraine in the field of waste management. It is argued that the term "owner of waste" does not fully correspond to the European approach, since the WFD uses the term "waste holder", which covers not only the owner in the property law sense, but primarily the person who has the waste in actual possession, under control, or at their disposal. It has been proven that the Ukrainian model terminologically shifts the emphasis from control, intent, and obligation to dispose of a substance or object to ownership, which creates conflicts with the provisions of the Civil Code of Ukraine [3] regarding the content, grounds for acquisition, and termination of ownership. It has been established that the generation of waste does not automatically give rise to an independent property right to "waste" as a separate object, and therefore the application of the concept of "waste owner" is questionable from a civil law perspective. Based on an analysis of Articles 3 and 15 of the WFD, as well as the decisions of the EU Court in the cases of Inter-Environnement Wallonie, Van de Walle, Mesquer, Tallinna Vesi, and Tronex, it has been shown that the behavior of the holder is of decisive importance: discard, intend to discard, required to discard. It is proposed to replace the term "waste owner" in the Law of Ukraine "On Waste Management" and related subordinate acts with "waste holder" as more accurate, functional, and consistent with European integration. The author's definition of waste holder and specific proposals for amendments to Ukrainian legislation have been formulated.
