PROSPECTS FOR THE DEVELOPMENT OF CRIMINALISTICS TACTICS IN THE DIRECTION OF INTEGRATING COVERT INVESTIGATION METHODS

Abstract

The article explores the scientific prospects of forming a modern branch of criminalistics tactics dedicated to developing recommendations for special, covert investigation methods. It is stated that expanding the subject of criminalistics tactics by including the tactical foundations of covert investigative (search) actions is an objective demand of the time, which will increase the efficiency of combating crime and ensure proper verification of evidence obtained through specific methods. Analysis of the evolution of the theory and practice of criminalistics tactics indicates that the methodology for applying special covert investigation methods was formed on its foundations, yet within a specific branch of the theory of operational-search activity — operational-search tactics. Consequently, the provisions of the latter regarding measures that are essentially related to covert investigative (search) actions constitute the practical foundation for forming a new branch of criminalistics tactics. At the same time, the theoretical basis of this field should be the fundamental principles of criminalistics, ensuring the development of scientifically grounded recommendations that meet the admissibility criteria for tactical techniques. Integrating provisions regarding covert investigative (search) actions into the content of criminalistics tactics requires not only the development of innovative tools but also the improvement of general theoretical provisions. In particular, there is an urgent need to clarify the subject of criminalistics tactics and adjust its conceptual framework to ensure a reasonable balance between overt and covert means of gathering evidence. Special attention is required for the issues of preventing provocation, as well as rethinking the ethical aspects of the admissibility of disinformation and the use of «legend» (cover) in criminalistics activity.
