Abstract

The article, based on the experience of EU member states, examines the status of the head of the prosecution service, focusing on the specific features of the procedure for his appointment and dismissal, interaction with other state authorities, and its influence on determining the place of the prosecution service within the constitutional system of state power. It is substantiated that European standards do not establish a single universal constitutional model of the prosecution service or a mandatory procedure for appointing its head; instead, guarantees of independence, professionalism, political neutrality, and protection against undue interference are of decisive importance. Based on a comparative legal analysis, the models of the prosecution service and the status of its head in the Czech Republic, Slovakia, Latvia, and Slovenia are examined. The constitutional and legal foundations of the prosecution service in Ukraine following the 2016 constitutional reform are analyzed, as a result it was found, that there is a contradiction between the orientation toward the functioning of the prosecution service within the judicial branch of government and the politically dependent mechanism for the appointment and dismissal of the Prosecutor General. Particular attention is paid to the assessment of the European Commission, which, in its 2025 Ukraine Report, points to problems in the legislative regulation of the procedure for the selection and dismissal of the Prosecutor General and emphasizes the need to bring these procedures into line with European standards. The need to improve the procedure for the selection and termination of the powers of the Prosecutor General is substantiated through the introduction of transparent professional criteria, competitive mechanisms, the involvement of prosecutorial self-governance bodies, and the strengthening of guarantees of independence from political influence, taking into account European standards and the experience of the Member States of the European Union. These findings enhance the understanding of the current state of prosecutorial reform in Ukraine and may serve as a basis for determining the directions necessary to complete this process in accordance with European standards.
