LEGAL REGULATION OF FINANCIAL SUPPORT FOR SCIENCE IN UKRAINE: CURRENT CHALLENGES AND DIRECTIONS OF MODERNIZATION

The article examines the current state of legal and financial support for scientific and scientifictechnical activities in Ukraine. It is substantiated that proper funding of science is not only a prerequisite for the functioning of scientific institutions, but also an important state guarantee for the implementation of the constitutional right to scientific creativity. The author analyzes the provisions of the Law of Ukraine “On Scientific and Scientific-Technical Activities” regarding sources of financial support for science, principles of budget financing and the functioning of the National Research Fund of Ukraine. Based on statistical data, a persistent trend towards an insufficient level of spending on scientific research and development in Ukraine compared to the legislatively defined benchmark and indicators of the European Union member states is identified. Special attention is paid to the new financing model, introduced since 2026, which provides for taking into account the results of state certification of scientific institutions and higher education institutions when distributing basic funding. It is established that the new model combines basic and competitive funding, creating the prerequisites for the transition from a predominantly budget-based approach to a system focused on the results, quality and long-term capacity of scientific institutions. The author emphasizes that the effectiveness of the reform will depend on the stability of budget funding, transparency of the distribution of funds, prevention of excessive administrative dependence of scientific institutions and ensuring real autonomy of scientific activity. Based on the analysis of scientific views, proposals are formulated for further improvement of the mechanisms of financial support for science, in particular, increasing the share of scientific research expenditures in GDP, developing grant funding, introducing mechanisms for co-financing of science-intensive projects by the state and business, modernizing research infrastructure and strengthening the connection between the results of scientific research and the needs of the economy.
