THE TRANSFORMATION OF CIVIL-LAW RELATIONSHIPS IN THE CONTEXT OF UKRAINIAN MIGRATION TO THE EU

Abstract

This article examines the impact of contemporary migration processes on the transformation of civil law relations in the context of Ukraine’s European integration. It is argued that the intensification of international population mobility, the increase in the number of crossborder legal relationships, and Ukraine’s integration into the European legal space necessitate the adaptation of national civil legislation to the standards and principles of European Union law. Particular attention is paid to the analysis of the legal regulation of family, inheritance and contractual relations involving a foreign element, as well as mechanisms for the protection of the private rights of migrants and internally displaced persons. The study establishes that contemporary migration processes significantly influence the development of private international law, creating new challenges for Ukraine’s civil law system. It is demonstrated that the harmonization of national legislation with EU law contributes to enhancing the effectiveness of legal protection for individuals in cross-border legal relations, ensuring legal certainty and strengthening mechanisms for the realization of human rights. At the same time, a number of problems have been identified relating to conflicts of law, the insufficient level of implementation of European legal standards, and the need to improve the institutional and procedural framework for the realization of migrants’ civil rights. The methodological basis of the study comprises general scientific and specialized legal methods of inquiry, in particular the dialectical, systemic-structural, comparative legal, formal-legal methods, and the method of scientific generalization. Their application has enabled a comprehensive examination of the interrelationship between migration processes and the development of civil law in Ukraine within the context of European integration reforms. The study concludes that there is a need for further improvement of the civil law mechanism for protecting migrants’ rights in accordance with European standards, as well as the advisability of developing effective models for regulating cross-border private law relations in the context of contemporary demographic, socio-economic and security challenges.
