CONSTITUTIONAL RENEWAL AS THE FOUNDATION OF UKRAINE’S POST-WAR RECOVERY

Abstract

The article examines constitutional renewal as a key prerequisite for the post-war recovery of Ukraine in the context of the transformation of statehood, society, and the legal system. It substantiates that, following the end of the Russian-Ukrainian war, the Constitution of Ukraine should serve not only as a guarantor of constitutional stability but also as a strategic foundation for the modernization of the state in accordance with contemporary challenges and the European vector of development. It is argued that the renewal of the Basic Law should be carried out through the further development of its provisions while preserving the fundamental constitutional values of the rule of law, democracy, popular sovereignty, human rights, and Ukraine’s European choice. Particular attention is paid to the constitutional consolidation of Ukrainian national identity, the improvement of the system of checks and balances among the branches of government, the strengthening of judicial independence, and the further development of local self-government. The article analyzes the principal directions for improving the constitutional foundations of national security, ensuring European and Euro-Atlantic integration, and substantiates the priority role of human capital, science, education, healthcare, and social protection as the cornerstone of Ukraine’s post-war development. of Special emphasis is placed on the constitutional and legal framework for the reintegration de-occupied territories, the implementation of transitional justice mechanisms, and the individualization of constitutional and legal restrictions applicable to persons whose activities were associated with the occupation administrations or posed a threat to Ukraine’s national security. It is emphasized that such restrictions must comply with the principles of the rule of law, proportionality, individual responsibility, and judicial oversight. The article concludes that post-war constitutional renewal should not amount to a revision of the current Constitution of Ukraine but rather to its evolutionary development aimed at establishing an effective model of a democratic, rule-of-law, social, and European state capable of ensuring sustainable development, national unity, security, and the successful post- war recovery of Ukraine.
