ACADEMIC PLAGIARISM AS A TYPE BREACH OF ACADEMIC INTEGRITY

The article analyzes the concept of academic plagiarism as one of the types of breach of academic integrity. The evolution of the concepts of "plagiarism" and "academic plagiarism" in the national legislation of Ukraine is studied. Attention is drawn to the fact that, unlike many other countries, in which the concept of "plagiarism" has not been legislated, the legislation of Ukraine not only uses two separate terms "plagiarism" and "academic plagiarism", but also defines them legally. The issue of the relationship between these concepts is analyzed. It was established that domestic researchers mainly consider them as a genus and species, considering academic plagiarism as a type of plagiarism. Disagreeing with this position, the author was guided by the fact that plagiarism is a violation of copyright, while academic plagiarism is a violation of academic integrity. From the point of view of logic, these concepts are contained in the relation of intersection, since not every academic plagiarism is plagiarism in the copyright sense, just as not every copyright plagiarism is academic plagiarism. There are three categories of actions that fall under the signs of plagiarism and (or) academic plagiarism: actions that are plagiarism in the copyright sense, but are not academic plagiarism; actions that are both plagiarism in the copyright sense and academic plagiarism; actions that are academic plagiarism, but not plagiarism in the copyright sense. This distinction is important, since plagiarism and academic plagiarism lead to the occurrence of different legal consequences. In the first case, it is about the civil remedies of copyright and (or) bringing the plagiarist to administrative or criminal responsibility, which is implemented by court. Otherwise, we are talking about the measures provided for by the legislation on education ("academic responsibility") and science, which are applied out of court. It is emphasized the expediency of specifying in local regulations adopted in institutions of higher education what constitutes academic responsibility, which can be applied for specific types of violations of academic integrity, in particular, for the admission of academic plagiarism.
