THE EMERGENCE AND FORMATION OF HINDU LAW

Abstract

The article is devoted to the development of Hindu law, its impact on modern legal systems and the role of religious norms, which are the basis of these legal systems. The factors of formation of Hindu law and their influence on the legal system are considered. Features of Hindu law and their impact on the Hindu legal system are described in detail. Special attention is paid to the agreement of religious norms, which became the basis of the written laws of the Hindu legal system. The influence of Hinduism on the formation of the legal system has been studied, and statistics on the country where Hinduism is the most popular religion have been published. The country where the scope of Hindu law extends is analyzed and its main properties are indicated. Trends in the development of Hindu law, including the secularization of law and the expansion of social relations, which were previously governed by customs. Attention is paid to other Hindu legal systems, their origin, distribution and functioning. The purpose of the study is to determine the main factors in the emergence and development of Hindu law. The relevance of the article lies in the fact that the Hindu legal system has a pronounced religious character, which is studied in modern laws and codes. Thus, there are results of a study of religious prescriptions for legislative activity. Among the results of the study it is necessary to highlight: belonging to the religiouscommunal subtype of the legal system; community-caste structure, characterized by stability and ability to adapt to changing living conditions; society’s perception of laws is higher than written laws; most of the laws of the country of Hindu law are based on normal English rights; dependence of the Hindu legal system on the British; unified and clearly formed centralized states based on the federal level of government.
