IMPROVING THE LEGAL MECHANISM OF INTERNATIONAL COOPERATION ON PREVENTING AND COMBATING TRANSNATIONAL CRIME

The article is devoted to the peculiarities of improving the legal mechanism of international cooperation in preventing and combating transnational crime. It has been identified that the issue of improving the legal mechanism of international cooperation in preventing and combating transnational crime has long been one of the key issues in this area. The article describes the most common problems that make it impossible to combat and prevent transnational crime in Ukraine. The article draws attention to a comprehensive study of the theoretical and legal foundations of international cooperation in preventing and combating transnational crime in Ukraine. The article presents and solves the scientific problem of developing a holistic concept of international cooperation in preventing and combating transnational crime, which provided an opportunity to justify proposals for improving existing legislation and the possibility of its practical application. The author proposes and uses the author’s interpretation of the concept of “international cooperation in preventing and combating transnational crime”, which is based on the principles of mutual and effective assistance and cooperation, and is provided through a clear and effective organizational and legal mechanism. The article describes various forms of international cooperation: extradition, mutual legal assistance, transfer of criminal proceedings to another country, transfer of convicts, cooperation for confiscation, cooperation between law enforcement agencies, including information exchange and cooperation in investigations, joint investigation in the use of special investigative methods. The basic principles of international cooperation in preventing and combating transnational crime have been formulated, among which the key role is given to the principles of cooperation, peaceful settlement of international disputes and the principle of non-use of force. The article states that further research should be aimed at improving the international legal regulation of combating transnational economic crime.
